Protection from Domestic Violence

Are you a victim of domestic violence or suffering from harassment from an ex-partner, husband or other family members? As family lawyers we can advise you on what steps you can take to protect yourself from harassment.

Being a victim of abuse, either physical, emotional, psychological, financial or sexual is never your fault. That is why we do our very best to ensure we can get you the protection you need. This is often by way of a court order, as the court provides protection to people who are being abused by associated persons such as family members, partners and parents and has the power to grant:

  • Non-Molestation orders – this order could be obtained on notice or without notice on an urgent basis and is used to protect the victim from harassing and molesting behaviour, threats of violence or actual violence from the abuser.
  • Occupation orders – this order prevents or excludes the abusive party from entering the family home or coming near the family home.

Each of the above orders carry a penal notice, making it a criminal offence if breached.

We can also assist by helping you apply for a divorce and help resolve financial issues and child arrangements from a partner who has been abusive.

Depending on the circumstances of your case, you could be eligible to apply for Legal Aid to obtain a non-molestation order and occupational order, and resolve other related issues. We shall let you know if you are eligible and assess you for Legal Aid.
